These terms apply to the Liftava app for Android, the Liftava watch app for Garmin devices and the website liftava.com (together “Liftava”). By creating an account or using Liftava you agree to them. Please read them together with our privacy policy.

1. Who provides Liftava

Liftava is provided by Vojtěch Procházka, a sole trader registered in the Czech trade register, company ID (IČO) 24433896, Švýcarská 2433, 272 01 Kladno, Czech Republic (“we”). Contact: support@liftava.com.

2. Your account

You must be at least 16 years old to create an account.
Give a real email address you can access: it is how you set a new password and how we contact you.
Keep your password, and the Google account you sign in with, to yourself. You are responsible for what happens in your account.
An account is for one person.

3. Your health comes first

Liftava is a training log with automated suggestions, not a doctor, physiotherapist or personal coach. Suggested weights, repetitions, quests and deload weeks are calculated from the data you log and are general guidance, not medical advice. Train within your abilities, use proper technique and safety equipment, and see a doctor before you start or change training if you have any health concerns. Stop if you feel pain or unwell.

4. Free and Pro

Liftava is free to use. Liftava Pro unlocks extra features (currently every weekly quest, unlimited training plans and charts for your whole history), as described in the app.

Purchase and billing. Pro is sold through Google Play as a monthly or yearly subscription. Google Play handles the payment, taxes, receipts and refunds under its own terms.
Renewal and cancellation. Subscriptions renew automatically at the end of each period until you cancel them in Google Play (Payments & subscriptions → Subscriptions). After cancelling you keep Pro until the end of the period you paid for. Deleting the app or your Liftava account does not cancel a subscription.
Free trial. If a trial is offered, it turns into a paid subscription when it ends unless you cancel before then.
Prices. Prices are shown in the app and in Google Play in your currency, including VAT. We may change subscription prices for future periods; Google Play will tell you in advance and, where required, ask for your agreement.
Your consumer rights. Refunds follow Google Play’s refund policy. Your statutory rights as a consumer are not affected. By starting to use Pro right after the purchase you ask us to provide the digital content immediately, which means the 14-day right of withdrawal for digital content ends once the provision has begun, as the law allows.

5. Fair use

Please do not:

break the law, or use Liftava to harm others;
try to access other people’s accounts or data, or interfere with the service, its security or its servers;
copy, scrape or resell the service or its content, or access it by automated means other than the app;
reverse engineer the app, except where the law allows it;
send invite links as spam, or put unlawful or offensive content into names, notes or plans you share.

We may suspend or close an account that seriously or repeatedly breaks these terms. We will tell you why, unless the law prevents it.

6. Your data and content

Your training data belongs to you. You give us the permission we need to store and process it to provide Liftava to you, for example to show your plans to friends you have connected with. When a friend copies one of your plans, the copy becomes theirs. How we handle your personal data is described in the privacy policy. You can delete your account and data at any time (how).

7. Our content

The app, its design, texts, exercise guides and code are ours or used under licence, and are protected by copyright. You may use them only within Liftava. Exercise drawings are by Everkinetic, licensed under CC BY-SA 4.0.

Liftava is not affiliated with Google, Garmin or Hevy. Their names and trademarks belong to their owners and are used only to describe compatibility.

8. Availability and changes

We work hard to keep Liftava running, but we provide it as it is and cannot guarantee it will always be available or free of errors. We keep improving Liftava and may change, add or remove features. If a change removes a significant part of a paid feature, we will tell you in advance, and you may cancel.

9. Liability

To the extent the law allows, we are not liable for indirect damage, lost profits or lost data, or for injuries resulting from how you train. Nothing in these terms limits liability that cannot be limited by law, such as for damage caused intentionally or by gross negligence, or for harm to life or health caused by us, and nothing limits your statutory rights as a consumer.

10. Ending

You can stop using Liftava and delete your account at any time. If we ever decide to stop providing Liftava, we will tell you at least 60 days in advance and give you a way to get a copy of your data.

11. Law and disputes

These terms are governed by Czech law. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim in its courts.

If we cannot resolve a complaint together, consumers can turn to out-of-court dispute resolution at the Czech Trade Inspection Authority (Česká obchodní inspekce, Gorazdova 1969/24, 120 00 Prague 2, adr.coi.cz).

12. Changes to these terms

We may update these terms. We will let you know about important changes in the app or by email at least 30 days before they take effect. If you do not agree, you can stop using Liftava and delete your account before then.
